SUBJECT

1.1. These General Terms and Conditions of Online Sale (hereinafter “GTC”) govern the contract (hereinafter ‘CONTRACT’) for the sale of clothing and accessories bearing the Smad brand (hereinafter “PRODUCTS”) offered by LANIFICIO FAISA Srl, Via Menabuoni Lorenzo, 14 – 59100 Prato (PO), ITALY – VAT number IT 01926190974 (hereinafter “Smad”) through its website www.smadstudio.com (hereinafter “WEBSITE”) to users of the WEBSITE (hereinafter ‘CUSTOMER’ or “CUSTOMERS”) .

1.2. In these GTC, the term CUSTOMER or CUSTOMERS refers to the “consumer” or “consumers,” pursuant to Article 3, paragraph 1, letter a) of Legislative Decree No. 206 of September 6, 2005 (hereinafter referred to as the “CODE”), i.e. “the natural person acting for purposes unrelated to any entrepreneurial or professional activity carried out.”

EFFECTIVENESS AND MODIFICATION OF THE GTC

2.1. The GTC are available on the WEBSITE and must be read by the CUSTOMER before registering and purchasing the PRODUCTS; they are deemed to be accepted upon registration and submission of the purchase order, and may be stored or printed by the CUSTOMER.

2.2. The GTC applicable to the sale are those published on the WEBSITE on the date of the order; the CUSTOMER must read them each time they intend to make a purchase.

2.3. Smad's tolerance or failure to contest any breaches by the CUSTOMER does not constitute tacit acceptance or derogation from the agreements between the parties.

REGISTRATION AND PURCHASE PROCEDURE

3.1. The CUSTOMER expresses their intention to purchase by registering and submitting the ORDER on the WEBSITE, following the procedure indicated.

3.2. The order contains a detailed summary of the products, prices, taxes, payment methods, and shipping costs; the CUSTOMER must verify its accuracy before sending it.

3.3. All orders are subject to the availability of the PRODUCTS and confirmation by Smad via email.

3.4. In the event of the unavailability of certain products, Smad will inform the CUSTOMER and request confirmation for the purchase of the available products; unavailability does not automatically authorize the total cancellation of the order.

3.5. The CONTRACT is governed by the ORDER, the SHIPPING CONFIRMATION, the GTC, and the Privacy Policy.

RIGHTS AND OBLIGATIONS OF SMAD

4.1. Smad delivers the PRODUCTS to the address and within the terms indicated by the CUSTOMER. It is not responsible for errors or unavailability.

4.2. In the event of return of the PRODUCTS due to the right of withdrawal or legal warranty, Smad shall refund the amounts due in accordance with Articles 10 and 11.

RIGHTS AND OBLIGATIONS OF THE CUSTOMER

5.1. The CUSTOMER is responsible for the accuracy of the data provided.

5.2. The CUSTOMER declares that they have read, understood, and accepted the GTC and the PRIVACY POLICY, and that they are of legal age and legally capable of acting.

5.3. The CUSTOMER is required to save or print the ORDER and the GTC for safekeeping.

USE OF THE WEBSITE

6.1. The characteristics of the PRODUCTS are presented on the WEBSITE; colors and images may differ from reality due to browsers or monitors.

6.2. Smad is not responsible for technical problems beyond its control, such as connection errors or delays in communications.

6.3. Smad undertakes to resolve any problems and offer rapid assistance to the CUSTOMER.

PRICES AND PAYMENTS

7.1. The prices of the PRODUCTS include VAT, unless otherwise indicated, and shipping costs are added.

7.2. The total amount will be charged to the CUSTOMER at the time of payment.

DELIVERY OF PRODUCTS

8.1. Upon delivery, the CUSTOMER must check the quantity, type, and integrity of the packaging.

8.2. Any anomalies must be reported immediately to the courier and communicated to info@smadstudio.com.

• Italy:  €10
• Europe:  €20
• Rest of the world:  €25–45 (depending on destination)

RETURNS

Returns of purchased goods must be made within 14 days of the delivery date.

The customer is responsible for the return shipping costs.

RIGHT OF WITHDRAWAL

9.1. The CUSTOMER may withdraw within 14 days of delivery, provided that the products are intact, unused, and complete with packaging and labels.

9.2. Returns must be made in a single shipment.

9.3. To exercise the right of withdrawal, the CUSTOMER must send an email to info@smadstudio.com attaching the order confirmation and indicating the products to be returned. The shipment must be made within 14 days of notification.

9.4. Smad may refuse returns of used, damaged, or unlabeled/untagged products.

9.5. Cash on delivery returns are not accepted.

RETURNS FOR FAULTS OR DEFECTS

10.1. Smad guarantees that its products comply with the law and requires proof of purchase for complaints.

10.2. For defective products, the CUSTOMER shall send an email with the order confirmation.

10.3. Smad will provide instructions for the return within 14 days and will arrange for replacement or refund at its own expense.

10.4. Smad may refuse returns for defective products without labels, tags, or that have been misused.

10.5-10.6. Smad will send confirmation of receipt and product checks before refunding or replacing.

PERSONAL DATA PROTECTION

11.1. Personal data will be processed lawfully and correctly in accordance with Legislative Decree 196/2003 and the PRIVACY Policy.

APPLICABLE LAW AND JURISDICTION

The GTC are governed by Italian law, in particular by the Consumer Code and Legislative Decree No. 70 of April 9, 2003.
